These Terms and Conditions govern your enquiry, booking, purchase, or any interaction related to Codename Roots Mamurdi (the "Project") via this informational portal managed by an authorized channel partner of Goyal Properties ("we", "us", "our") in Mamurdi, Pune. By submitting an enquiry, making a booking, or proceeding with purchase, you agree to be bound by these terms, the Builder-Buyer Agreement (to be executed with the Developer), and all applicable laws including the Real Estate (Regulation and Development) Act, 2016 ("RERA") and rules made thereunder.
Important Note: These are general terms for informational purposes. The final and binding terms shall be as per the Agreement for Sale / Builder-Buyer Agreement executed between you and the Developer in the format prescribed / approved under MahaRERA. All bookings and payments are subject to execution of the said agreement.
1. Booking & Application
- All bookings are provisional and subject to availability, approval, and execution of the Agreement for Sale.
- Booking amount shall not exceed 10% of the total consideration (as per RERA guidelines) unless the Agreement for Sale is executed.
- Booking is confirmed only upon receipt of the booking amount and issuance of booking confirmation by the Developer.
- The Developer reserves the right to accept or reject any application/booking without assigning reasons.
2. Payment Terms
- Payments shall be made as per the payment schedule mentioned in the Agreement for Sale or as communicated by the Developer.
- All payments must be made via cheque / demand draft / online transfer in favour of the account specified by the Developer (as per RERA mandate – 70% funds in project-specific account).
- Any delay in payment shall attract interest @ 2% per month (or as prescribed under RERA) on overdue amounts.
- Taxes, stamp duty, registration charges, GST, maintenance deposit, and other charges are payable as applicable and are not included in the base price unless specified.
- Prices are subject to change; final price shall be as per the Agreement for Sale.
3. Possession & Completion
- Possession shall be offered as per the timeline registered with MahaRERA, subject to force majeure events, approvals, and buyer fulfilling all obligations.
- Upon possession, the buyer shall take possession and pay all outstanding amounts, maintenance charges, society formation charges, etc.
- Delay in possession attributable to the Developer shall entitle the buyer to compensation as per RERA provisions.
4. Cancellation & Refund
- Cancellation before Agreement for Sale: Subject to deduction of administrative charges / booking amount forfeiture as per company policy / applicable laws.
- Post Agreement for Sale: Cancellation governed by the terms of the Agreement for Sale and RERA provisions (including forfeiture / refund with interest / compensation as applicable).
- All refunds shall be processed after deduction of applicable taxes and charges.
5. Representations & Warranties
- All information, specifications, amenities, and images are indicative / artistic impressions and subject to change / approvals / statutory requirements.
- The Developer does not guarantee any specific view, light, or ventilation unless expressly mentioned in the Agreement for Sale.
- Carpet area / saleable area is as per RERA definition and sanctioned plans.
6. Governing Law & Dispute Resolution
- These terms and the transaction shall be governed by the laws of India.
- Any disputes shall be subject to the exclusive jurisdiction of competent courts in Pune, Maharashtra.
- Disputes related to the Project may be referred to MahaRERA authority as per the Act.
7. Amendments & Updates
We may update these Terms & Conditions from time to time. The updated version will be posted here with a revised effective date. Continued interaction / booking constitutes acceptance of the updated terms.
